Welcome to Heartfelt Lens (https://heartfeltlens.com), a wedding and portrait photography business operated by Sylwia Misarko. By accessing our website, booking our services, or engaging with our content, you agree to the following Terms of Service.
1. Services Offered
Heartfelt Lens offers professional photography services, including but not limited to:
Wedding photography
Engagement sessions
Family, maternity, and newborn sessions
Event photography
Albums and digital image delivery
All services are subject to availability and will be confirmed upon booking.
2. Booking & Payment
A non-refundable deposit is required to secure your date.
The remaining balance is due by the date agreed upon in your individual contract.
Payments can be made via bank transfer to Heartfelt Lens.
The full amount is due even in the event of cancellation with less than 72 hours’ notice.
Late payment may incur additional fees.
3. Cancellations & Rescheduling
You may cancel or reschedule your session with at least 72 hours’ notice.
Less than 72 hours’ notice or a no-show may result in a cancellation fee equal to the session fee.
In the unlikely event that we cancel, we’ll offer a reschedule or full refund.
4. Delivery & Output
Final edited, high-resolution images will be delivered within 10 weeks of the session.
Delivery methods include: online gallery, USB stick, and/or other transfer services.
We do not provide unedited or raw images under any circumstances.
5. Usage Rights & Copyright
Clients receive non-exclusive, royalty-free personal usage rights, including:
Social media sharing
Personal printing
Private use on websites
The Photographer retains copyright to all images and may use them for portfolio, website, and promotional purposes.
Commercial use of any kind (ads, reselling, etc.) requires written consent.
6. Client Responsibilities
Ensure timely arrival and readiness of all necessary participants.
Provide accurate session details (location, timing, special requests).
Communicate any changes as early as possible.
7. Photographer’s Responsibilities
Deliver professional, high-quality images using professional-grade equipment.
Conduct sessions respectfully and professionally.
Use creative discretion to select and edit final images.
Deliver within the promised timeline.
8. Liability
Heartfelt Lens is not responsible for:
Any injuries during a session
Delays caused by weather, traffic, illness, or venue rules
Lost or damaged physical products after delivery
Our total liability is limited to the fees paid by the client.
9. Website Use
All content on heartfeltlens.com is owned by the Photographer and may not be reused without permission.
You may not copy, scrape, or redistribute any content or media without express consent.
10. Privacy Policy
We value your privacy and handle your data in accordance with UK GDPR regulations. For more, see our Privacy Policy.
11. Force Majeure
We are not liable for failure to perform due to unforeseen events such as:
Natural disasters
Acts of terrorism
Sudden illness or injury
We will offer a reschedule or refund where appropriate.
12. Governing Law
These terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of UK courts.
